NOTICE REGARDING THE SENDING OF COMMERCIAL ELECTRONIC COMMUNICATIONS
In accordance with Law No. 6563 on the Regulation of Electronic Commerce and relevant legislation, a commercial electronic message refers to messages containing data, sound and images sent for commercial purposes via electronic means, such as telephone, call centres, fax, automatic dialing machines, intelligent voice recording systems, email and short message service.
Commercial electronic communications may only be sent to recipients provided their prior consent has been obtained. Commercial electronic communications may not be sent to recipients who do not have consent recorded in the Commercial Electronic Communications Management System (‘IYS’). This consent may be obtained in writing, via any means of electronic communication, or through the IYS. Consent obtained via the IYS must include an explicit expression of consent and an electronic communication address. Recipients may opt out of receiving commercial electronic communications at any time, without having to provide any reason. The recipient’s notification of refusal invalidates the consent relating to the communication channel through which the notification was made. The recipient may also exercise their right to refuse via the IYS. Where the recipient has provided their contact details for the purpose of being contacted, no separate consent is required for commercial electronic communications regarding changes, use and maintenance of the goods or services supplied.
It is not mandatory to obtain prior consent for commercial electronic messages sent to the electronic communication addresses of recipients who are traders or tradespeople. However, if traders or business owners exercise their right to opt out as set out in the relevant legislation, commercial electronic messages may not be sent without their consent. In this context, prior to sending a message, the electronic communication addresses of recipients who are traders or business owners are recorded in the IYS by the service provider, and the IYS is used to check whether the recipients have exercised their right to opt out.
In accordance with Law No. 6563 on the Regulation of Electronic Commerce and relevant legislation, even if you have given your consent to the sending of commercial electronic messages, you may opt out of receiving them at any time without having to provide a reason. We would like to remind you that you may submit your opt-out notification via the same communication channel through which the commercial electronic message was sent, in a simple and free manner. You may also exercise your right to opt out via the IYS.
